Terms of Service

These Terms of Service ("Terms") govern your use of the Genitor platform ("Platform", "Service", "Genitor", "we", "our", "us") and define the mutual rights and obligations between you and us. By registering on the Platform, creating an account, or using the Service in any manner, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

Genitor is a SaaS platform operated by Genitor, Inc., a Delaware C-Corporation registered in the United States. The Platform enables users to build websites with the help of artificial intelligence, host them, connect custom domains, and manage their content through a built-in content management system (CMS). If you do not agree to these Terms, you must not use the Service.

1. Introduction and Acceptance

These Terms constitute a legally binding agreement between you and Genitor. They cover use of any part of the Platform, including the website, mobile interfaces, APIs, the templates marketplace, and the creator program.

Genitor, Inc. is a Delaware C-Corporation, registered in the State of Delaware, USA, and is subject to the laws of the State of Delaware. The official address for legal correspondence is [email protected].

By using the Platform, you confirm that you are at least 18 years old or otherwise have full legal capacity in your jurisdiction, and that you have the authority necessary to comply with these Terms.

2. Definitions

For the purposes of these Terms, the following definitions apply:

  • Platform — the Genitor web platform, including all of its modules, subsystems, APIs, and related infrastructure.
  • Service — the AI-powered website builder, hosting, CMS, templates marketplace, creator program, and supporting features delivered through the Platform.
  • User — any individual or legal entity that creates an account on or otherwise uses the Platform.
  • Account — the profile a User creates to access the Platform, secured by email and password or by Google OAuth.
  • Project — a website created by a User on the Platform, together with its dedicated Postgres database, files, template, and configuration.
  • User Content — text, images, video, code, and any other material that a User uploads, enters, or generates through AI on the Platform.
  • Subscription — a User's enrollment in a paid plan and the corresponding recurring payment obligation.
  • AI Output — any material (text, code, design suggestions) produced by AI models in response to your prompts.
  • Template — a ready-made design and structure package (free or paid) offered on the Platform that can be applied to a Project.
  • Creator Profile — the public profile of an approved creator program member published at /u/{slug}.
  • Custom Domain — a domain name owned by the User and connected to a Project on the Platform.
  • Subdomain — an address automatically provisioned under *.genitor.net.
  • Database — the isolated Postgres schema and the data stored within it for each Project.
  • Confidential Information — any non-public information disclosed by one party to the other in connection with the Service.

3. Eligibility and Account Registration

To use the Platform, you must be at least 18 years old or otherwise have full legal capacity under the laws of your country of residence. If you are registering on behalf of a legal entity, you confirm that you have the authority to do so.

You must provide accurate, complete, and up-to-date information during registration and keep it current. An individual may hold only one primary account; creating multiple accounts in order to bypass subscription limits, credits, or other restrictions is prohibited.

You are solely responsible for the security of your Account. You must not share your password with third parties and should enable two-factor authentication where available. If you become aware of any unauthorized access to your Account, you must contact [email protected] immediately.

Genitor offers registration via Google OAuth. When you sign in with Google, Google's Terms of Service and Privacy Policy also apply.

4. Description of the Services

Genitor is a platform that enables users to build fully functional websites by sending instructions (prompts) to artificial intelligence. Each generated site is automatically deployed on a subdomain under *.genitor.net, and every Project is provisioned with an isolated Postgres database and CMS.

You may also use additional capabilities such as connecting your own custom domain to a Project, selecting free or paid templates from the templates marketplace, using the AI assistant for ongoing edits and updates to your site, applying to the creator program, and, once approved, maintaining a public profile.

Genitor's technical infrastructure is hosted in Hetzner (Germany) data centers. Network security and SSL are provided through Cloudflare. Outages or failures at these third-party providers may result in temporary unavailability of the Platform.

We reserve the right to update, modify, or expand the functionality, design, and available plans of the Service at any time. We will endeavor to give advance notice of material changes.

5. Subscription Plans and Free Tier

Genitor offers a Free tier and several paid subscription plans. The Free tier provides users with a limited number of AI credits, a single project slot, and access to core features so they can explore the Platform and build small projects.

Paid plans unlock additional benefits such as more AI credits, a higher number of concurrent projects, custom domain connection, larger database capacity, priority support, and access to an expanded template catalog. The exact quotas and pricing of each plan are set out on the Platform's pricing page.

Some features operate on a prepaid credits model. Credits are either renewed when the subscription renews or purchased separately as one-off bundles — the rules for using them are described in each plan's specification.

When choosing a plan, please consider:

  • The monthly AI credits included in the plan and the rules for using them;
  • The number of active projects you can hold simultaneously;
  • Whether the plan supports custom domain connection;
  • The maximum size limit for your project database;
  • The technical support response time;
  • Eligibility for the creator program (subject to approval).

6. Acceptable Use

When using the Platform, you agree to comply with applicable law, generally accepted standards of conduct, and these Terms. The subsections below clarify what is permitted and what is prohibited.

6.1. Permitted Use

You may use the Platform for personal, commercial, non-commercial, agency, and corporate purposes. Building client projects, portfolio sites, blogs, e-commerce storefronts, and similar products is permitted.

6.2. Prohibited Content

It is prohibited to create, publish, or store the following types of content on the Platform:

  • Unlawful activity, smuggling, drug trafficking, or the sale of weapons;
  • Hate speech, discrimination, racist material, or content that promotes violence;
  • Material that infringes copyrights or other intellectual property rights;
  • Malicious software, viruses, phishing pages, or sites designed to deceive users;
  • Child exploitation material or adult pornographic content;
  • Misleading or forged documents, disinformation, and fake news campaigns;
  • Unlicensed gambling sites and betting services;
  • Cryptocurrency fraud, "rug pull" schemes, unregistered ICOs, and similar scams;
  • Forms designed to collect personal information without authorization.

6.3. Prohibited Conduct

The following actions against the Platform itself are prohibited:

  • Reverse engineering, decompiling, or attempting to uncover the internal structure of the Platform;
  • Unauthorized scraping, automated harvesting, or abuse of the APIs;
  • Using deceptive techniques to circumvent AI credit limits or other quotas;
  • Creating multiple accounts to exceed limits or evade restrictions;
  • Mass registration via automated bots or scripts;
  • DoS/DDoS attacks or attempts to overload or damage the infrastructure;
  • Using the identity of a third party to access the Platform;
  • Continuing to use the Service by creating new accounts after a formal ban or account suspension.

7. User Content and Ownership

You retain all rights in the content you upload, enter, or generate through AI on the Platform. Genitor does not claim ownership of your content.

In order for the Platform to operate and provide the Service to you, you grant Genitor a worldwide, non-exclusive, royalty-free license to host, process, back up, display, distribute, and make any technically necessary modifications to your content. This license is granted solely for the purpose of providing the Service.

You represent and warrant that the content you upload to the Platform is lawful, does not infringe any third-party rights, and that you have obtained any necessary consents. You are solely responsible for any breach of these obligations.

8. Notice About AI Output

The Platform's AI features generate material based on your prompts. This material is produced by statistical models rather than human authors and may not always be accurate, complete, or of high quality.

AI Output may contain factual errors, biased statements, controversial phrasing, and material similar to works covered by third-party rights. It is your responsibility to read, verify, and edit AI Output as necessary before publishing it.

You must not rely on AI Output as legal, medical, financial, or other professional advice. Genitor does not warrant the originality or accuracy of AI Output or that it is free of third-party rights infringement.

You bear sole responsibility for any content you publish and for the consequences arising from it.

9. Hosting, Subdomains, and Custom Domains

Each Project is automatically provided with a subdomain under *.genitor.net. Subdomain names must be unique and must not infringe existing logos, trademarks, or other rights of any user. Subdomains may be reclaimed in cases of abuse.

If you wish to connect a custom domain, it is your responsibility to point the relevant DNS records (CNAME or A) to the values supplied by the Platform. SSL certificates are provisioned automatically through Cloudflare; however, where DNS for the domain remains with a third party, Genitor is not responsible for issues on that third-party side.

Genitor strives to maintain a high uptime for the Service but does not guarantee uninterrupted operation. Scheduled maintenance, third-party provider issues, and force majeure events may cause temporary outages.

10. Project Databases

A separate, isolated Postgres schema is created for each Project. This schema serves only your Project, and you have no access to the data of other users.

You are in control of the data you store in the database. A size limit applies to each plan; if the limit is exceeded, the Platform may restrict further writes or require an upgrade.

You act as the Data Controller in respect of personal data you store within your Project's database. You may store personal data of third parties only where you have obtained their consent or have another lawful basis. Genitor acts as the Data Processor and processes such data only to the extent necessary to provide the Service.

11. Templates Marketplace

The Genitor templates marketplace offers both free and paid templates. Templates may be produced by the Genitor team or by members of the creator program.

Templates are not finished, end-use products — they are starting points for your Project. Each template ships with sample content (copy, images, brand colours, product/service listings, etc.). You are responsible for adapting the template to your business: replacing the sample content with your own name, products, contact details and legal information, and adjusting design and functionality where needed. Genitor is not liable for issues arising out of the public use of a template's sample content as-is, including but not limited to misleading information, infringement of third-party rights, or brand confusion.

Free templates may be used by you in an unlimited number of projects. Paid templates are licensed for use in a single specific Project and may not be transferred to other users.

The underlying files, code structure, and design elements of a template remain the property of Genitor or the relevant creator. You may not resell, redistribute, or republish a template in the form in which it is offered on the marketplace.

If a paid template has not been used (i.e. has not been applied to a Project), you may request a refund within 7 (seven) days of purchase. Once a template has been applied to a Project, refunds are no longer available.

12. Creator Program

The creator program enables experienced users to obtain creator status and a public profile at /u/{slug} on the Platform.

To apply, you must submit a short bio, examples of at least 3 (three) completed projects, and a motivational pitch describing why you wish to participate. Applications are reviewed by the Genitor team and a response is typically provided within 7 business days.

If your application is rejected, a 20 (twenty) day cooldown period applies before you may reapply. During that period, identical or substantially similar applications are blocked automatically by the system.

Approved creators are listed in the Platform's creator directory, on public profiles, and on the relevant template pages. Genitor reserves the right to revoke creator status, hide, or remove a profile in the event of a breach of these Terms or of Platform policies.

13. Third-Party Services

Genitor relies on a number of third-party providers to deliver the Service. Their own terms and privacy policies apply to certain aspects of your use of the Platform.

Key third-party providers include:

  • Hetzner Online GmbH — server and hosting infrastructure (Germany);
  • Cloudflare, Inc. — CDN, DDoS protection, and SSL certificates;
  • Google LLC — registration and authentication via Google OAuth;
  • Payment processor — subscription enrollment and payment processing (Stripe or an equivalent provider);
  • AI model providers — model compute services used to generate AI Output.

13.1. Third-Party Outages

Genitor is not liable for temporary unavailability of the Service caused by outages or failures of the third-party providers listed above, but will take prompt operational steps to resolve any such issues.

14. Intellectual Property

The Genitor name, logo, design, source code, documentation, templates produced by the in-house team, and other visual elements are the intellectual property of Genitor or its licensors. These Terms grant you only a limited, revocable, non-exclusive license to benefit from the Service.

Templates created by community creators belong to their respective authors and are made available to you under the license terms displayed in the templates marketplace.

You retain copyright in your own content and the original portions of your project. At the same time, you warrant that the material you upload to the Platform does not infringe any third-party rights.

15. Payments, Billing, and Refunds

Paid subscriptions are billed in advance for the relevant period (monthly or annually). **All Genitor subscription prices are denominated and charged in U.S. Dollars (USD)** regardless of the user's location. Any currency conversion is performed by your card issuer at their applicable rate. Applicable taxes (EU/UK VAT, US sales tax, and any other tax required by your jurisdiction) are calculated and added transparently by Stripe Tax at checkout. Upon automatic renewal, the Platform charges the payment method you have provided.

Unless explicitly stated otherwise in the plan, prepaid credits must be used within 12 (twelve) months. Unused credits are not refunded if your account is closed or suspended for breach of these Terms.

For users in the European Union (EU) and other applicable jurisdictions, local taxes (e.g. VAT) may be added to the payment. The tax amount is shown clearly on the checkout page.

Refunds: if you have not used the Service within 7 (seven) days following a subscription renewal (for example, no AI credits have been spent and no new project has been created), you may request a full refund. Refunds are not available for credits already consumed or services already used.

If a payment fails, a 7 (seven) day grace period applies. Projects will be temporarily suspended if payment is not made within that period.

16. Price Changes

Genitor may change the price of existing plans on at least 30 (thirty) days' prior notice. Notice is delivered by email and/or via the dashboard.

For existing subscribers, the price remains fixed for the current billing cycle. The new price takes effect at the start of the next cycle. If you do not agree to the price change, you may cancel your subscription before the new cycle begins.

17. Suspension and Termination by Us

Genitor reserves the right to suspend, restrict, or fully terminate your Account or Projects in the following cases:

  • Breach of these Terms or of Platform policies;
  • Failed payment and non-payment after the 7-day grace period;
  • Abuse, fraud, or behavior that poses a security risk;
  • A formal request from a competent authority or a court order;
  • More than 12 (twelve) months of total inactivity (free accounts only);
  • Confirmed fraud, phishing, or distribution of malicious software.

17.1. Notice

Where reasonably possible, we provide notice before suspension and a reasonable period to remedy the issue. However, in cases of serious violations (e.g. illegal content or large-scale abuse), suspension may be applied without prior notice.

18. Termination by You

You may cancel your subscription or close your Account at any time through the dashboard. For paid plans, termination takes effect at the end of the current billing cycle, and you continue to enjoy the plan's features until that point.

Before closing your Account, it is your responsibility to back up your content and export any data you wish to keep. Project databases and files can be exported in SQL/JSON formats.

Following termination, content recovery is possible only within 30 (thirty) days, subject to technical feasibility, and may be subject to an additional fee.

19. Consequences of Termination

Upon termination of an account or subscription:

  • Your Projects are deactivated immediately or at the end of the billing cycle;
  • Custom domains are detached at the DNS level and become available again;
  • Project databases are kept in archive for 30 (thirty) days and then permanently deleted;
  • Any unused balance on a paid plan is non-refundable if termination is the result of a breach of these Terms;
  • Participation in the creator program ends automatically and the public profile is removed;
  • Paid licenses purchased on the templates marketplace cease to be valid once the corresponding Project is deactivated.

20. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Genitor disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your specific expectations.

21. Limitation of Liability

To the maximum extent permitted by law, the total liability of Genitor and its officers, employees, and agents to you is limited to the total amount you have paid us in the 12 (twelve) months preceding the event giving rise to the claim.

In no event shall Genitor be liable for any indirect, incidental, consequential, special, or exemplary damages, including lost profits, lost data, business interruption, or expected benefits, even if we have been advised of the possibility of such damages.

Some jurisdictions do not permit such limitations; in those jurisdictions, liability is limited to the minimum extent permitted by law.

22. Indemnification

You agree to defend, indemnify, and hold harmless Genitor, its affiliates, officers, employees, and agents from and against any claims, damages, and costs (including reasonable attorneys' fees) arising out of your content, your use of the Platform, or your breach of these Terms or of any third-party rights.

The indemnification obligation survives the termination of your account in respect of claims based on facts that occurred prior to termination.

23. DMCA and Copyright Infringement Notices

Genitor respects intellectual property rights. If you believe that any content hosted on the Platform infringes your copyright, you may send a notice to [email protected].

Your notice should include:

  • A description and source of the work that is the subject of the dispute;
  • The exact URL on the Platform of the content alleged to be infringing;
  • Your contact information (name, email, address);
  • A statement confirming your rights in the material;
  • A solemn statement that the information in your notice is accurate and that you have the necessary authority;
  • Your physical or electronic signature.

23.1. Counter-Notice

If you believe that your content was removed in error, you may submit a counter-notice to the same address. Repeat infringers will have their accounts terminated entirely.

24. Reporting Abuse

If you discover unlawful, deceptive, harmful, or otherwise Terms-violating content on a subdomain hosted on the Platform, please send a report to [email protected].

Reports are reviewed within 5 (five) business days. In cases of serious violations, content may be removed or made inaccessible immediately following an initial review.

25. Force Majeure

Neither party is liable for failure to perform its obligations as a result of events beyond its reasonable control. Such events may include natural disasters, war, terrorism, government actions, large-scale internet outages, mass cyberattacks, and prolonged failures of third-party providers.

Once the force majeure event ends, the parties will take reasonable steps to restore the Service as quickly as possible.

26. Changes to the Terms

Genitor may update or modify these Terms at any time. Material changes will be communicated at least 14 (fourteen) days in advance by email and/or via a banner in the dashboard.

Continuing to use the Platform after the new Terms take effect constitutes acceptance of those changes. If you do not agree to the new Terms, you may close your account before the effective date.

27. General Provisions

  • Severability — If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
  • No Waiver — A delay in enforcing any right is not deemed a waiver of that right.
  • Assignment — Genitor may assign its rights and obligations under these Terms to a successor or affiliate. You may not assign your rights without our prior written consent.
  • Entire Agreement — These Terms and the documents referenced in them constitute the entire agreement between the parties.
  • Headings — Section headings are for convenience only and have no legal effect.

28. Governing Law and Dispute Resolution

These Terms and any disputes arising out of them are governed by the laws of the State of Delaware, USA. The parties accept the exclusive jurisdiction of the state and federal courts located in Delaware for any disputes.

Before resorting to litigation, the parties shall attempt in good faith, for at least 30 (thirty) days, to resolve any dispute through negotiation via [email protected].

29. Effective Date

These Terms are effective as of May 2, 2026. They supersede all earlier versions. To request access to previous versions of the Terms, please email [email protected].
